as the one responsible for carrying out no 907/ΕΥΥΑΠ 884/25.5.2018 Ε.Α.Τ.Α. ΑΕ application form for the program ΠΟΛΗ² of the Municipality of Athens within the framework of the Intervention under the title «Digital benches Digital Intervention to selected benches in Pagkrati» with the rest of the team and for the sake of brevity will be from now on mentioned as (“we/us/the team”).

Any user that enters and / or makes use of the Website is considered to agree and accept unconditionally the terms stated below, with no exception. In case the user does not agree to these terms, he / she must refrain from using the Website and from all transactions with it.

 

1.1 ABOUT THE INTERVENTION

ΠΟΛΗ² [CITY SQUARE] is a program realized by E.A.T.A. A.E. within the framework of the development agenda of the Municipality of Athens. The program offers small financial grants and development support to residents, businessmen and groups of the society of citizens, in order to proceed with cooperative interventions in the city, which would not be realized otherwise. The project «INTERVENTIONS IN THE CITY» of the program ΠΟΛΗ² is a pilot implementation of applied practices that adopt the reasoning of «urban acupuncture», in other words, the carrying out of small scale subtle interventions within the urban web, which will aim to enhance the city’s function as well as its image. The project requires the participation of communities, local businesses and groups of citizens, not only in the planning of the interventions but also in their implementation. Having constructed a supporting mechanism and studied pilot activities that were realized within the framework of programs by the Municipality of Athens as well as respective European practices, the particular action aims at upgrading the role and significance of the neighborhood and enabling its social resources.

This study was approved and will be sponsored by ΠΟΛΗ², of the Municipality of Athens, under the theme line «NEIGHBORHOOD». The region of upgrade is placed in the 2nd Municipal Community (Pagkrati-Neos Kosmos) Athens and particularly in Pagkrati.

The project Digital benches aims to collect stories by the residents of Athens and make them available in six selected benches in the area of Pagkrati through the website www.digitalpagakia.gr.

The benches obtain a narrative dimension beyond their function and the public space becomes a place for expression and social interaction. To every bench correspond different stories. The stories are told by the residents and passer-by’s themselves. When the user finds himself in one of the six benches, he can listen to the stories that are there. The only thing necessary is a smartphone, 3G and earphones! Benches have always been a place of day-to-day narration, the action Digital benches came to collect the stories and create, through a digital platform, a museum of memories from every-day people in the heart of the city! The action aims to offer a pedestal to the unique stories of every-day people in order for them to be heard and to remain in time, the benches to obtain a narrative dimension beyond their function and the public space to become a place for expression and social interaction.

The benches are located in the following spots

  1. Evagelismos Park (by the exit from the metro station)
  2. Spirou Merkouri (opposite the supermarket AB Vasilopoulos)
  3. Within the Park of Pagkrati near the exit towards Eftichidou Street
  4. Opposite Palas Cinema in Pagkrati off Imitou Street
  5. Mesologiou Square (Pagkrati)
  6. Ebedokleous Street Οδός Εμπεδοκλέους (pedestrian precinct) off Archimidous Street (Kalimarmaro Stadium)

1.2 CONTENT OF STORIES

The story with a maximum duration of 2 minutes will be uploaded on the Website in the way described on the page ‘Record’ from adults above 18 years-old (+18).

By participating in the intervention, you agree that you will not:

  • use the intervention for any purpose that is illegal or that is forbidden by this contract,
  • use the intervention for any reason of advertising – promotion of products and services directly or indirectly,
  • impersonate any person or being or publish an other person’s material without his / hers permission,
  • proceed to intimidation, harassment or defamation of any person,
  • upload anything that violates the rights of other users, including publicity rights, private life, copyrights, trademarks or other intellectual property or conventional rights,
  • publish anything that consists of a rhetoric of hatred, threat, sexual or pornographic content, or that incites violence or contains violence,
  • publish any content that promotes racism, intolerance, hatred or physical abuse of any kind against any group or person,

Our team reserves the right beyond the technical processing of the material in order to improve the quality of sound / voice for the amelioration of the audience’s experience (e.g. isolation of voice from other elements such as car sounds), to explore and / or delete your registration (subscription), if you have used the service in a wrong way or have acted in a way the team considers inappropriate for the purposes of the existing action or illegal.

 

1.3 MATERIAL USE

By entering a story the participants explicitly consent / allow:

  1. a) the registry of their story to sound carrier material,
  2. b) the direct or indirect reproduction of the story aiming at the review of the action, sampling or its presentation
  3. c) the direct or indirect reproduction of the story with all means as well as its circulation by conveyancing, leasing or borrowing of the carrier material by the team, in any means
  4. d) the broadcast in any way, such as electromagnetic waves, satellites, cables, as well as presentation to the material carrier’s audience through the registry of the story in which he / she participates by the present
  5. e) the use / processing of the material of their story for the time period at least until March 2020 when the program

The story in which the user will participate can be exploited commercially or not and used by the team as well as any person added to the team for an unlimited number of hearings in television (public and private) within the Greek territory, in radio, print editions and online (site, facebook etc).  It is explicitly agreed that the Participant has no claim, financial or other, deriving from his / hers participation in the hereunto action, the registration of his / hers story, and its reproduction and exploitation from the team.

All legal disputes that result from or in relation to the hereunto statement will be exclusively ruled by the Greek justice under the local jurisdiction of the Courts of Athens.

 

  1. USE OF WEBSITE

Please read carefully the Terms of Use before using the Website. The Website’s Terms of Use apply to all visitors and users of the site, as well as to the Content (as defined below), regarding information, suggestions, products and services provided to you through the Website. Having access to / and by using the Website, you grant your consent to the Terms of Use of the Website in their total, as in any other law or regulation applicable to the Website and the Internet. In our team we respect the personal data of every visitor of the Website «www.digitalpagakia.gr». This text titled Data Protection and Privacy Policy explains in simple and intelligible language and clarity how we process the personal data we collect from you or which you provide to us.

The team collects only the personal data that are voluntarily provided by you, our online visitors as well as those who accept to record a story, in order for us to publish your story, to provide you with information regarding our action and to serve you in the best way possible.

Where additional, optional information, is requested, you will be notified at the time of its collection.

The management and protection of the personal data of the visitor / user of our Website is subject to the terms of the hereunto statement as well as to the defined by the national and communal law regarding the protection of the person from the processing of personal data, as this is contextually in force.

Whatever potential future relevant regulation will be incorporated in the hereunto statement. In any case, the team holds the right to change the data protection terms, according to the contextual relevant legal frame in force.

Therefore, the current data protection terms may be revised and updated at any time and without warning.   • WHAT PERSONAL DATA WE COLLECT

The team collects personal data of visitors / users of the Website, only when they themselves willingly provide them in order to record, publish their story or simply listen to a story as a third party.

Personal data are the data that can be used to identify or communicate with a person as well as other data that concern that person.

In particular, in order to participate to our action by recording / publishing your story you will be asked for a NAME and an E-MAIL ADDRESS as well as the title of your story whereas if you wish to participate as a simple listener of the stories you do not need to state your data.

Within the framework of the function of our action it is necessary to track the location of the participant / user of the Website within 20 meters from the location of the bench and for that reason we process the gps location of the device of users and only for that reason.

Those of you who have provided us with your consent to process your data for the purposes above you reserve the right to revoke your consent provided at any time by addressing  info@digitalpagakia.gr for deleting, correcting etc your data as these are mentioned in paragraph 3.5 of the hereunto statement.

 

  • WHAT IS THE USE OF THESE DATA

This data is processed by the team in accordance to the provisions of Regulation (EU) 2016/679 (GDPR) aiming to inform the user and in no way shall they be disclosed, published or sold to third parties unless there is a legal obligation.

 

Purpose of taking, processing and maintaining your personal data that relate to contact details is done with your consent to satisfy the exclusive purpose of the action and publishing of stories in predetermined locations (6 benches in the area of Pagkrati) and the listening of the stories within a distance less than 20 meters from them.

The team Does Not Process “sensitive” personal data unless you voluntarily offer us this data or when this data is required or collected by law. We advise you to refrain from providing sensitive data (for example, medical data).

The team may ask you to provide certain personal data in order to send you updates regarding the news of this or another action and / or relevant announcements. The team may also request your permission for certain uses of your personal data and you can either consent or deny these uses.

If you require specific services or communications, such as an electronic information leaflet (Newsletter), you will be able to unsubscribe from the relevant list of recipients whenever you choose to by following the instructions contained.

If you decide to unsubscribe from a service or communication, we will try to delete your data as soon as possible, although we may need certain time and / or provision of additional information necessary to confirm your identity before processing the request.

If you wish, you can apply anytime to be informed about your personal data held by the team, their recipients, the purpose of maintaining and processing them as well as their amending, correcting, portability or delete by sending a relevant e-mail to  info@digitalpagakia.gr using the email address you have provided while we may ask you for additional information to confirm your identity without excluding the possibility of your burden at the cost.

You also have the right to review the personal data that we process and generally to exercise every right provided by the legislation on the protection of personal data, while in any other case where you consider that you are infringing a right or the team does not comply with its entitled obligations, you reserve the right to file a complaint to the supervisory authority. The team does not share or transfer personal data with / to third parties, unless this is required for legitimate purposes and the needs for the realization of the intervention, in order to respond to your requests and / or if applicable or permitted by Law. In any case, access to your personal data is permitted only to authorized personnel who are required to have access in order to be able to complete the purposes of their collection, use and processing, as communicated by this declaration. Individuals who have access to the data are obliged to respect the confidentiality of such data.

 

3.4 COOKIES

3.5 YOUR RIGHTS IN RELATION TO PERSONAL DATA

3.5.1. RIGHT TO INFORMATION:

You reserve the right to request information regarding the personal data we received from you and maintain for some purpose / purposes as stated in paragraph 3.1. The hereunto statement is in its sum a manual of basic information and understanding on the philosophy of the regulation frame which rules the protection of your personal data.

 

3.5.2. RIGHT TO ACCESS:

You reserve the right to request from our team access to your data which we maintain and confirmation as to if they are being processed and in particular information about the purposes of processing, the categories of personal data, the recipients or the categories of recipients, the period of time of maintaining and processing them, the right to file a report to the Hellenic Data Protection Authority (HDPA), every available information about the origin of the data if those have not been provided by yourself, the existing or not of automatized decision-making process including profiling and the relevant methodology, warranties regarding the policy we follow when transferring takes place to third countries, copy of the personal data that are maintained and are being processed.

The team makes every reasonable effort to keep personal data processed only for the period of time the data is needed for the purpose in which it was obtained or until it is requested to be deleted (if that happens earlier), unless we are obliged to comply with the provisions of the legislation.

For security reasons and especially to deal with any malicious attacks files that contain data (such as IP) of users are stored for a period of three months time after which they are automatically deleted.
